Football in pubs ruling upheld by the High Court

The legal ruling by the European Court of Justice earlier this year has been upheld by the highest court in England, meaning that pub landlady Karen Murphy can use her Greek satellite decoder to show any football match she likes to her customers.

The Independent reports today (see Pub landlady Karen Murphy wins High Court case - The Independent ) that

"It was conceded in the High Court today that Karen Murphy's appeal over using a cheaper Greek decoder in her Portsmouth pub to bypass controls over match screening must be allowed."

and that Karen Murphy said outside court that:

"It's a moral victory," she added. "This was big corporations thinking they are above the law."

This follows the ruling Broadcasting territorial exclusivity with a decoder card is contrary to EU law from the European Court of Justice, following the notice given 12 months ago, Karen Murphy scores against the Premier League and Sky.

The paper also reports that:

Mrs Murphy, who ran The Red, White and Blue pub in Portsmouth, Hampshire, said she believed she had won "90%" of the battle.

But the Premier League claimed a partial victory, after the ECJ said it maintained the copyright for some sections of the broadcast.

The "some sections of the broadcast" are the theme music played before and not specifically any part of the actual game.

I would like to see and end to this overcharging for Sky TV in this Country. It is high time someone came up with a way to override the sky card so we could all watch it for free. They used to be able to do this - I don't know why it is so difficult to do. They should only charge for Sky Movies, Box Office and LIVE Sports. All the rest should be free to view. Paying out hundreds and even into the £1000 bracket per year per household is scandalous. As far as i am concerned it is just as bad as the phone hacking scandal and it wants to be stopped. People don't realise they are paying this as it comes out monthly from people's bank accounts and has a drain on the family finances all adding to debt. As far as i am concerned the Murdoch Empire gets none of my money as i can see straight through it. I wish everyone else could see it.

Sky have had a good innings. Some pubs I sell European Systems to, were being quoted £40k a year by Sky.

For Sky to link their subscription to a commercial RV, is obscene. Now the law has changed, I hope that licensees can take full advantage of it, by switching.

Despite the change in law, Sky are still actively harrassing pubs, and frightening licensees into taking out Sky subscriptions: Licensees need to realise that they now have a choice, and that there are legal alternatves to Sky.

What is 'legal' about Sky ? Their CEO, and owner doesn't pay tax here, so why should he have the use of our legal system to enforce his rules ?
